4. Eligibility

The promotion is open to residents of participating countries who are aged 18 years or older.

Canadian entrants must also have reached the age of majority in their province or territory of residence.

Employees of the Promoter and members of their immediate families are not eligible.

5. How to enter by purchase

No promotional code or separate registration is required.

Every qualifying order placed during a Weekly Promotion automatically receives one entry into that Weekly Promotion's worldwide purchase draw.

Customers may place more than one qualifying order. Each genuine qualifying order receives one entry.

Products are sold at their normal retail prices and there is no additional fee charged to participate in the promotion.

Canadian residents may also enter without making a purchase in accordance with clause 18.

6. Qualifying orders

A qualifying order is a paid retail order placed through a participating Brooklyn website during the applicable Weekly Promotion.

The following are not qualifying orders:

• cancelled or unpaid orders
  
• fraudulent orders
  
• wholesale or trade order
  
• orders placed through third-party marketplaces
  
• replacement or warranty orders
  
• exchange orders
  
• orders manually created by The Brooklyn
  
• additional charges associated with an exchange, including upsizing charges
  

Where a customer returns or exchanges a previous purchase and a new order is created for administrative purposes, that new order does not receive an entry.

The Promoter may exclude orders that it reasonably believes have been artificially split or otherwise created primarily to manipulate the promotion.

7. Number of purchase winners

For each Weekly Promotion, there will be one purchase winner for every 10 qualifying purchase orders received worldwide during that Weekly Promotion.

The number of purchase winners will be calculated by dividing the total number of qualifying purchase orders by 10 and rounding up to the next whole number.

For example:

• 100 qualifying orders = 10 purchase winners
  
• 125 qualifying orders = 13 purchase winners
  
• 207 qualifying orders = 21 purchase winners
  

Accordingly, the chance of a qualifying purchase order being selected will be approximately 1 in 10 and may be slightly better depending on the total number of qualifying orders received.

The exact number of prizes cannot be known until the applicable Weekly Promotion closes because it depends on the number of qualifying orders received.

8. Worldwide purchase draw

After each Weekly Promotion closes, all qualifying purchase orders from all participating countries and participating Brooklyn websites will be combined into one worldwide purchase draw pool.

The required number of purchase winners will then be selected at random using a computer-generated random selection process.

Every qualifying purchase order included in the applicable draw will have an equal chance of being selected.

An order may only be selected once in the same Weekly Promotion.

The draw will take place after entries for the applicable Weekly Promotion have closed.

The draws will be conducted by the Promoter at 74 Taharoto Road, Takapuna, Auckland, New Zealand.

9. Purchase prize

Each winning purchase order receives 50% of its eligible product total back.

The prize is calculated on the amount actually paid for eligible products after discounts have been applied.

The prize does not include:

• shipping or delivery charges
  
• gift card purchases
  
• amounts paid using gift cards
  

The prize is processed in the same currency as the original order.

The value of individual prizes will vary because it is based on the value of each winning order.

10. Receiving a purchase prize

No claim form is required, except where clause 18 applies to Canadian residents.

Purchase winners will be notified using the email address associated with their order.

The Brooklyn will process the 50% refund to the original payment method within 3 business days of the applicable draw, subject to any additional verification required under these terms.

The time taken for funds to appear after processing depends on the customer's bank, card issuer or payment provider.

11. Returns and cancellations

The promotional prize is based on the value of eligible products ultimately retained by the customer.

If a winning order is cancelled in full, entitlement to the promotional prize ends.

If all products in a winning order are subsequently returned, the promotional prize will be deducted from the amount otherwise refundable.

If only part of a winning order is returned, the promotional prize will be recalculated as 50% of the eligible product value retained by the customer, and the customer's return refund may be adjusted accordingly.

Exchange orders and any additional payment associated with an exchange do not themselves qualify for the promotion.

Nothing in this clause affects any rights a customer has under applicable consumer protection laws.

12. Verification and replacement winners

Before processing a prize, The Brooklyn may verify that the selected entry complies with these terms.

If a selected order is found to be ineligible, another qualifying entry will be selected at random in its place.

The Promoter may disqualify an entry where it reasonably believes there has been fraud, automated entry, artificial order splitting, identity manipulation or other conduct intended to improperly manipulate the promotion.

13. Draw transparency

The Promoter may record and publish footage of each weekly draw.

The Promoter may publish winning Brooklyn Order Numbers, winner initials, first name and/or the winner's country or region for the purpose of demonstrating the conduct and results of the promotion.

A winner's full name or other identifying personal information will not be published without consent unless disclosure is required by applicable law.

14. Draw records

The Promoter will retain appropriate records relating to each Weekly Promotion, including:

• eligible entries
  
• the number of entries
  
• the number of winners drawn
  
• the random selection process
  
• winning entries
  
• prizes awarded
  

Records will be retained for any period required by applicable law.

15. Changes or cancellation

The Promoter may amend, suspend, postpone or cancel a Weekly Promotion where reasonably necessary because of circumstances outside its control, technical failure, fraud, legal or regulatory requirements or another circumstance that materially affects the fair operation of the promotion.

Any material change will be published on the promotion page.

Entries already received will be honoured wherever reasonably possible and lawful to do so.

16. Consumer rights

Nothing in these terms excludes, restricts or modifies any consumer right or remedy that cannot lawfully be excluded under the laws applicable to the customer.

For New Zealand customers, this includes any applicable rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

Customers in Australia, Canada and Singapore retain any mandatory consumer rights available to them under the laws applying in their place of residence.

17. Privacy

Personal information collected in connection with an order or entry may be used as reasonably necessary to administer the promotion, conduct the draws, verify eligibility, contact winners and provide prizes.

Personal information will otherwise be handled in accordance with The Brooklyn's Privacy Policy.

18. Canada

18.1 No purchase necessary

Canadian residents may participate without making a purchase.

To enter free of charge, an eligible Canadian resident must complete the free-entry form at:

A maximum of one free entry per person is permitted for each Weekly Promotion.

A free entry is allocated to the Weekly Promotion in which the completed entry form is received.

No purchase is necessary to submit a Canadian free entry.

18.2 Canadian free-entry draw

Eligible Canadian no-purchase entries will be included in a separate free-entry draw conducted during the same weekly draw session.

For every 10 eligible Canadian free entries received during a Weekly Promotion, one free-entry winner will be selected at random, rounded up to the next whole number.

Each eligible Canadian free entry in the applicable Weekly Promotion will have an equal chance of being selected.

18.3 Canadian free-entry prize

Each successful Canadian no-purchase entry receives CAD $20 Brooklyn Store Credit.

Store Credit will be issued electronically and may be used on a participating Brooklyn website, subject to the normal conditions applying to Brooklyn Store Credit.

18.4 Skill-testing question

Before any prize is awarded to a Canadian resident, whether the entry was made by purchase or without purchase, the selected entrant must correctly answer the following mathematical skill-testing question without assistance:

(15 × 4) + 20 − 35 ÷ 5 = ?

The question will be sent to the selected entrant by email.

The selected entrant must provide the correct answer within 7 days of the email being sent.

If the selected entrant does not provide the correct answer within that period, they will cease to be eligible for the prize and a replacement entrant will be selected at random.

19. Social media platforms

Where the promotion is advertised on Meta, Facebook, Instagram, TikTok or another third-party platform, the promotion is not sponsored, endorsed, administered by or associated with that platform unless expressly stated otherwise.

20. Governing law

These terms are governed by New Zealand law.

Nothing in this clause limits any mandatory rights, protections or regulatory requirements applying to an entrant under the laws of their country, state, province or territory of residence.
